A school or applicant for licensure may request reconsideration of any determination by the Bureau of Proprietary School Supervision (BPSS) to deny licensure or disapprove any other form of approval sought (e.g., curriculum approval, quarters approval, enrollment agreements, etc.) and may provide additional information in support of its request using the following procedures:

  1. Send an e-mail to bpss@nysed.gov with [ Name of School ] – Appeal in the subject line. The e-mail should include information about the specific nature of the request for reconsideration and provide all supporting documentation the party believes is relevant for reconsideration.
  2. A request for reconsideration, including all supporting documentation, must be received by BPSS no later than 10 days from the date of the initial determination. If a request for reconsideration is not received within 10 days, the initial determination shall be the final agency determination.
  3. If BPSS receives a timely and properly submitted request for reconsideration, the next highest level of management will review the matter and render a decision as to whether the initial determination will stand or be revised.
  4. BPSS will review all timely and properly submitted requests for reconsideration and issue a written determination. This will serve as a final agency determination.

Note: Matters of disciplinary action pursuant to Education Law § 5003 shall not be appealed through these procedures.
